APPENDIX 3 TO SALES CONTRACT NO_____________ENTERED INTO BETWEEN OÜ SAMIKS AND ___________________________ IDEMA KITCHENS – warranty against defects regarding functioning of the furniture |
In the furniture production process, only tested materials, parts, mechanisms and connection details with selected high quality are used. Functioning and durability of materials and structures are continuously monitored in the factory and tested in independent research laboratories. The furniture complies with SFS quality standards. The use of high quality materials, tested work and production methods that are under continuous monitoring, professional skills of the staff and quality awareness enable us to provide the ordered kitchen cupboards and sliding door systems with a three-year warranty against defects (hereinafter the Warranty) regarding functioning of the furniture.
WARRANTY TERMS AND CONDITIONS
Initial date of warranty The warranty shall enter into force at the delivery to the purchaser.
Warranty period The warranty for the furniture is valid for three years.
Essence of warranty The warranty includes the following furniture parts under traditional home and residential use: • Constructional durability of doors, shelves, ceilings, floors and connection details; • Functioning of handles, hinges, metal drawers, waste carriages and their slides.
Restrictions The warranty shall not include: • Normal wear and tear; • Normal discolouration; • Defects arisen from the household appliances or other equipment connected, aggregated or integrated to the furniture (causing excessive heat, wet, insufficient ventilation, etc.); • Installation of furniture; • Indirect damages.
Validity of warranty The warranty is valid provided that • Present warranty certificate is appropriately completed; • Warranty certificate, invoice and receipt for paying the full sum shall be presented; • Preservation, storage and installation, daily maintenance and service of the furniture is performed according to the manufacturer’s instructions using relevant professional skills; • Manufacturer’s instructions regarding protection of furniture from moisture are followed; • Furniture is used under traditional home and residential conditions; • Furniture is not overloaded or used in an untraditional manner; • All instructions regarding use, maintenance and storage and other such instructions are followed.
WARRANTY COMPENSATION
In order to start the investigation process for warranty compensation, the purchaser shall contact the seller. In case of defects regarding the quality of the product, the seller and purchaser shall draw up a bilateral agreement registering the defects of the product. The seller shall exchange the product not complying with the quality requirements and standards free of charge. The purchaser shall notify the seller of the found nonconformity within two weeks as of learning or becoming informed of the nonconformity. If a defect is found in the furniture to be compensated under the warranty terms and conditions, the seller shall replace the defective part with the new part and send it (uninstalled) to the client within the Republic of Estonia free of charge. In case the availability of the corresponding new part is aggravated, the seller shall replace it with the most similar corresponding part as soon as possible after the obligation of compensation is confirmed. Some colour variations between the furniture delivered during the warranty period and initially delivered furniture are allowed. The colour variations shall not involve the seller’s compensation obligation. If the warranty compensation includes a part or connecting detail, mechanism, model of door, etc., the availability of which is aggravated due to termination of production but the purchaser demands replacement of the original part, the seller shall serve the right to pay the purchaser compensation in the sum of the original price of the part under the warranty. Pursuant to subsection 230 (5) of the Law of Obligations Act, the warranty against defects shall not exclude or restrict the purchaser’s right to apply other legal remedies provided by the law or the agreement.
